Case Summary

A proposed Settlement Agreement (the “Settlement”) was reached between the parties in the class action lawsuit Greene, et al. v. Shift Operations LLC, et al., Case No. CGC 16-552307 (S.F. Sup. Ct.) (filed May 31, 2016) on behalf of 191 individuals who worked for the employer as Car Concierges, Car Enthusiasts, Operations Specialists, Inside Sales Representatives, and similar or related positions. The lawsuit alleged the employer misclassified individuals in these positions as exempt from overtime and meal and rest breaks, in addition to other legal violations. The employer denies these allegations. The Court did not rule on the merits of the claims or employer’s defenses.

The Court ordered preliminary approval of the Settlement on February 23, 2018. Notice of the Settlement issued to the 191 class members on March 16, 2018. A final approval hearing was held on June 19, 2018 at 9:00a.m. in Department 304 of the Superior Court of California, County of San Francisco. The Court ordered further briefing and additional information to be filed no later than July 11, 2018, which Class Counsel timely submitted.

On July 24, 2018, the Court issued an order granting final approval of the class action settlement and entered judgment in the case.
