Case Summary

A proposed Settlement Agreement (the “Settlement”) has been reached between the parties in the class action lawsuit Moses, et al. v. Adecco, Case No. 2017-1-CV-311980 (Santa Clara Sup. Ct.) (filed June 19, 2017) on behalf of 268 individuals who worked for the employer as California recruiters. The lawsuit alleges the employer misclassified individuals in these positions as exempt from overtime and meal and rest breaks, in addition to other legal violations. The employer denies these allegations. The Court has not ruled on the merits of the claims or employer’s defenses.

The Court ordered preliminary approval of the Settlement on March 23, 2018. Notice of the Settlement issued to the 268 class members on April 6, 2018. A final approval hearing is set for October 26, 2018 at 9:00 a.m. in Department 5 of the Superior Court of California, County of Santa Clara.
