Case Summary
The Plaintiffs in this case are current or former Staff Appraisers for Bank of America or Landsafe (together, Defendants or BofA) who brought suit on behalf of themselves and all other Staff Appraisers who were employed by BofA in the past three years. The Plaintiffs allege that the Defendants violated Federal law (the Fair Labor Standards Act, or “FLSA”) by denying class members overtime pay.
In particular, during the relevant period, Plaintiffs contend that Federal law required Defendants to pay Appraisers overtime (1.5 times the regular rate of pay) for any hours worked in excess of forty hours per week.
Defendants have denied Plaintiffs’ claims in this matter, contending that all class members were paid properly.
On December 11, 2013, the Court issued an order conditionally certifying the FLSA class, so that a notice would issue to all Appraisers nationwide who worked for Defendants since August 2010.
