Case Summary

Plaintiffs Joselito Dela Cruz and Jeff Pangilinan (“Plaintiffs”) are former employees of Defendants.  Plaintiffs sued Defendants for violations of the California Labor Code and Business & Professions Code, including causes of action for: (1) failure to pay minimum wages; (2) failure to compensate for all hours worked; (3) failure to pay overtime wages; (4) failure to compensate for split shifts; (5) failure to reimburse business expenses; (6) failure to provide accurate itemized wage statements; (7) failure to pay earned wages upon discharge; (8) unlawful and/or unfair business practices in violation of California Business and Professions Code; (9) penalties under the California Labor Code Private Attorneys General Act of 2004 (“PAGA”); in addition to (10) failure to pay minimum wages and overtime wages pursuant to the federal Fair Labor Standards Act (“FLSA”).  Defendants deny Plaintiffs’ allegations and contend that they properly paid the Plaintiffs and provided reimbursement of business expenses.
