CASE SUMMARY
In February 2012, Plaintiffs filed a wage and hour class action against Adventures Rolling Cross Country (ARCC), a small Northern-California-based teen adventure travel provider. The action was brought on behalf of its "Trip Leaders," seeking unpaid minimum wages, unpaid overtime, premiums for missed meal and rest breaks, penalties for inaccurate pay stubs, and related claims. The Court dismissed wage claims for time during which the Trip Leaders worked abroad, but time when they were training, preparing, and debriefing in the United States – and time spent on domestic trips – survived. The parties conducted discovery and fought several motions before the Court. Ultimately, after the Plaintiffs defeated ARCC's claimed exemptions from federal and state minimum wage laws in April 2013, the Court certified a class of Trip Leaders with claims under California law, as well as a collective action class of Trip Leaders with claims under the Fair Labor Standards Act, in July 2013.

After two failed attempts at mediation in 2012 and early 2013, the parties finally negotiated a conditional settlement in August 2013, which changes ARCC's system of operations, to make Trip Leaders subject to the minimum wage and overtime laws when they are working domestically, and which provides the class with $500,000 in wages and penalties and interest, minus attorneys' fees and costs. On September 24, 2013, the Court granted preliminary approval to the settlement.
