Case Summary

 A proposed Settlement Agreement (the “Settlement”) was reached between the parties in the class and collective action lawsuit Luis Duque, et al. v. Bank of America, et al., Case No. 18-cv-01298-PA-MRW (C.D.Cal.) (filed July 26, 2018) on behalf of roughly 321 individuals who worked on behalf the employer as Client Advocates, Senior Client Advocates, Operations Consultants, and Senior Operations Consultants (“Advocates”). The lawsuit alleges that the employer misclassified individuals in these positions as exempt from overtime and meal and rest breaks, in addition to other legal violations. The employer denies these allegations. The Court did not rule on the merits of the claims or employers defenses.

The Court ordered preliminary approval of the Settlement on November 8, 2018. Notice of the Settlement issued to the class and collective action members on January 16, 2019. After a final approval hearing, on May 13, 2019 at 1:30 p.m. in Courtroom 9A at First Street Courthouse, 350 W. 1st Street, 9th Floor, Los Angeles, California 90012, the Court issued an order granting final approval of the Settlement and entered a Judgment. Settlement checks will issue to participating class members according to the schedule set forth in the Settlement.
